In the OPSEU Pension Plan an eligible spouse must meet the definition of spouse and the eligibility requirements. A spouse is defined as someone, of the same or opposite sex, with whom you:
- are married
OR
- are living together in a conjugal, common-law relationship
- for at least three years
OR
- in a relationship of some permanence and are the natural or adoptive parents of a child.
If you die before your pension begins, to be eligible, your spouse must not be living separate and apart from you at the time of termination from the Plan and at the time of your death.
How to let OPTrust know about change in relationship:
If your marital status changes, please complete a new 1015 with the new information and send it to OPSEU Pension Trust. You can also use Online Services to update your spousal information. We can most accurately identify your spouse, whether married or common-law by their name, social insurance number and birth date. A spouse may not be eligible for spousal survivor benefits if you are living separate and apart, at the time of death.
